That there were poor communication and record keeping in relation to serious incidents. Recommended: That officers maintain a journal be reinstated, that these journals should not be destroyed without approval from an assistant commissioner and should be regularly inspected. Never done (Martin Callinan destroyed diaries and 10 black sacks of evidence)

 

2nd report by Judge Morris stated that the statements taken by Gardaí in the investigation of the death of Richie Barron were obtained by “coercion and doctoring and were fabricated corruptly obtained”. That there was “gross negligence by senior officers and other Gardaí”. Judge Morris found the investigation “corrupt in its leadership” and that these corrupt actions by Gardaí were “swept under the carpet”. NBCI described to a tea here. Recommended: He recommended the establishment of a whistle-blowers charter. (The Disclosures tribunal shows how that went, with whistle-blowers being framed in 2018)

 

3rd report stated that witnesses had been threatened and that detectives “concocted extraordinary and sinister lies”. “That the giving of evidence was scandalise and calculated to undermine the integrity and fairness of the trial, it was disgraceful conduct.” That there was deceitful and underhanded conduct.

 

4th report exposed the tampering with evidence and the planting of explosives by Gardaí in order to frame people. Recommended: continuous training of Gardaí (does not happen).

 

5th report exposed Gardaí planting guns to try and frame people for the murder of Eddie Fitzmaurice, and Gardaí framing other Gardaí. People were unlawfully arrested and mistreated in Garda custody. That the procedure for obtaining warrants could be circumvented and that there was a lack of safeguards to stop this happening. Gardaí falsified theories, evidence destroyed and got rid of.

 

6th report how people unlawfully arrested in a murder inquiry were treated shockingly and repulsively. They were kicked and beaten and abused. Roisin McConnell, Mark McConnell’s wife and Katrina Brolly. Safeguards in relation to detention ignored and detention was illegal. Statements were fabricated and fraudulently filled out by Inspector John McGinley which led to the framing of Frank McBrearty Jnr for the murder of Richie Barron, who was later promoted to Superintendent. Judge Morris called it a “catastrophic injustice of wrongful arrest and abuse in custody”. “The arrest was characterised by humiliation conduct publicly with a large Garda presence.” Human rights breached. Member in charge did not act independently, as he should do. “Physically and mentally draining”. NBCI detective Garda John White was attached to NBCI (Murder squad) and he stated how corrupt the Gardaí are

Recommended: The PEACE model be fully implemented for interviewing in AGS. Recording of interviews should be done and failure to do so should result in the exclusion of evidence in court. That exercise facilities should be available for people detained. Gardaí should have refresher courses.

 

7th report exposed the lack of responsibility by senior Garda officers. How the Garda Siochana Complaints Board was not independent and lacking resources.

 

8th report dealt with the anonymous allegations concerning the Carty Inquiry. Judge Morris described the GRA (Garda Representative Association) as consistently deceitful, incorrigible and unbiddable. (They still are in 2019, involved in tax evasion, bullying, fraud etc.) That there was no supports for dealing with problems. No counselling available for Gardaí. No awareness training for the pressures that Gardaí would come under. No confidential reporting system in place to deal with serious issues. Promotions in the Gardaí involved a process of political recommendations. No Headquarters officers at any level and no official of the department of justice was censured. (Nothing has changed still the same in 2019, as was revealed in the Disclosures Tribunal) Judge Morris chronicled serious breaches of human rights of citizens and abuses of the powers afforded to the police by society. He called again for full implementation of all recommendations made across all reports.

 

TD Nora Owen was furious over the completely fabricated finds by Gardaí. “ There is a flawed political approach to policing in Ireland.

The European Committee for the prevention of Torture (ECPT) has repeatedly found support for allegations of physical abuse by Gardaí/detectives in Ireland.
